End User License Agreement and Terms of Service

These End User License Agreement and Terms of Service (the "Terms") form a binding agreement between you and HeirStories ("HeirStories," "we," "us," or "our") governing your access to and use of our websites, web application, hosted software, content tools, AI-assisted features, memorial pages, reader and collaborator sharing tools, digital-heir features, and related services (collectively, the "Service").
By accessing or using the Service, creating an account, clicking to accept these Terms, purchasing a subscription, or using any paid feature, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Authority
- You must be at least 18 years old and legally able to enter into this agreement.
- You may use the Service only if doing so is lawful where you live.
- If you use the Service for an entity, trust, family office, or other organisation, you represent that you have authority to bind that person or entity.
2. The Service
HeirStories is a digital legacy and life-story platform that lets users create chapters about their lives, upload media, invite readers and collaborators, generate AI-assisted writing output, export stories, designate a digital heir, and optionally release content after the account holder's death through private or public memorial experiences.
Some features are free, some require a paid subscription, and some require one-time purchases such as AI credits or AI passes. Features and limits vary by plan.
3. License Grant and EULA
Subject to these Terms, HeirStories grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for your personal, internal, and non-commercial use in connection with preserving, organising, sharing, or reviewing life-story content through the Service.
You may not:
- copy, sell, lease, sublicense, distribute, or commercially exploit the Service except as expressly allowed by us in writing;
- reverse engineer, decompile, disassemble, or attempt to extract source code, except to the limited extent applicable law prohibits that restriction;
- circumvent security, plan limits, credits, paywalls, access controls, or rate limits;
- scrape, spider, crawl, frame, mirror, or systematically harvest the Service or its content;
- use the Service to build a competing product or training corpus;
- remove, alter, or obscure proprietary notices, trademarks, or attribution.
All rights not expressly granted to you are reserved by HeirStories and its licensors.
4. Accounts, Authentication, and Security
- You must provide accurate, current, and complete information and keep it updated.
- HeirStories uses passwordless email magic-link login and may also offer Google sign-in. Access to your email account is therefore part of your account security.
- You are responsible for all activity that occurs under your account, including activity by anyone who gains access through your email, devices, browser sessions, or links you share.
- You must promptly notify us if you suspect unauthorized access, compromised email, stolen devices, or misuse of your account.
- We may suspend or restrict access, require re-verification, or invalidate sessions when reasonably necessary for security, fraud prevention, abuse prevention, or legal compliance.
5. User Content, Invited Content, and Permissions
"User Content" means any text, stories, chapter content, prompts, notes, photographs, videos, audio, profile images, names, memorial content, collaborator submissions, metadata, or other material uploaded, created, submitted, or made available through the Service.
- You retain ownership of your User Content, subject to the rights you grant in these Terms.
- You grant HeirStories a worldwide, non-exclusive, royalty-free license to host, store, copy, reproduce, process, adapt, format, transmit, display, and distribute your User Content only as needed to operate, secure, improve, back up, moderate, provide, and support the Service.
- You also authorize us to make your User Content available to the specific people and audiences you choose through the Service, including invited readers, invited collaborators, your designated digital heir, and public viewers for content you mark or that is later released as public.
- If you invite a reader, collaborator, or digital heir, you are responsible for ensuring you have the right to share the related content and personal data with that person.
6. Your Content Responsibilities
You are solely responsible for your User Content and represent, warrant, and agree that:
- you own the content you submit or have all rights, permissions, consents, and releases needed to submit it and authorize the uses described in these Terms;
- your User Content, and our use of it as permitted by these Terms, will not infringe, misappropriate, or violate another person's rights, including privacy, publicity, copyright, trademark, contract, or other rights;
- you will not submit unlawful, fraudulent, defamatory, hateful, threatening, exploitative, sexually explicit, or otherwise harmful material;
- you will not upload malware, malicious code, or deceptive files;
- you will not use the Service to harass, stalk, impersonate, extort, or invade the privacy of any person;
- you will not submit sensitive personal data about other living individuals unless you have a lawful basis and permission to do so.
7. Readers, Collaborators, and Shared Access
- You control whether to invite readers and collaborators, but you are responsible for the consequences of those invitations.
- Collaborator content may be stored alongside your story content and may remain associated with your account unless removed by you or by us under these Terms.
- Readers receive view access only to content the Service makes available to them based on your settings, release state, and plan limits.
- We do not independently verify whether an invited reader, collaborator, or heir is the person you intended to invite if they authenticate using the invited email address.
8. Digital Heir and Memorial Features
- You may designate a digital heir using the Service. You are responsible for keeping that designation current and accurate.
- If a person verifies control of the designated heir email address through our heir-access flow, we may treat that person as authorized to act in the role of your designated heir.
- Your designated heir may be able to mark your account as deceased, review story content, set memorial preferences, change visibility for released content, edit certain content, or delete certain content, subject to product limitations.
- We may rely on the Service's records, account settings, authentication signals, and submitted dates without conducting independent probate, estate, identity, or kinship investigations.
- We are not responsible for disputes among family members, heirs, executors, beneficiaries, collaborators, or other claimants concerning authority over an account or memorial content.
- We may pause, refuse, limit, or reverse heir-related actions if we receive a credible dispute, inconsistent instructions, fraud concern, court order, or other legal risk.
9. AI-Assisted Features
- The Service may send your prompts, chapter text, story excerpts, metadata, and related context to third-party AI providers in order to generate writing prompts, summaries, rewrites, translations, interview questions, obituary drafts, eulogy drafts, historical context, or similar outputs.
- AI output may be inaccurate, incomplete, biased, offensive, or unsuitable for your situation. It may also resemble content provided to other users.
- You are solely responsible for reviewing, editing, verifying, and deciding whether to use AI-generated output.
- You must not rely on AI output from the Service as legal, medical, mental-health, tax, financial, or estate-planning advice.
- We may log AI feature usage, token counts, credits used, and associated chapter identifiers for billing, abuse prevention, analytics, and support.
10. Media Uploads and Public Content
- You may upload only file types and sizes that the Service allows.
- You are responsible for backing up your originals. The Service is not an archival system guaranteed against loss or corruption.
- If you or your designated heir set content to public or memorial-public visibility, that content may be viewable by anyone and may be indexed, cached, captured, quoted, or redistributed by others outside our control.
- Once content has been publicly accessed or copied by third parties, we may be unable to fully remove all downstream copies even if you later delete or restrict it.
11. Paid Plans, Auto-Renewal, Credits, and Passes
- Paid subscriptions renew automatically at the billing interval presented at checkout unless canceled before the next renewal date.
- By starting a paid subscription, you authorize recurring charges to your selected payment method until cancellation.
- Plan features, quotas, chapter limits, collaborator limits, reader limits, AI entitlements, and storage allowances may vary by tier and may change prospectively.
- We may offer one-time purchases such as AI credit packs or time-limited AI passes. Unless expressly stated otherwise, credits and passes are non-transferable, non-refundable, have no cash value, and may expire.
- If a payment fails, we may retry the charge, suspend paid features, place the account in read-only mode, reduce access, or cancel the subscription.
- If you downgrade or cancel, some paid features may stop immediately while others may remain available until the end of the current billing period, depending on the product flow and payment status.
- You are responsible for all taxes, duties, levies, and similar governmental charges associated with your purchases, except taxes on our net income.
12. Billing, Refunds, and Chargebacks
- Payments are processed by third-party providers such as Stripe. We do not store your full payment card number or card security code.
- Except as required by law, fees are non-refundable, including prepaid subscription fees for partial billing periods and unused credits or passes.
- If you believe a charge was made in error, you must contact us promptly through the Service or at the support address below before initiating a chargeback where reasonably possible.
- If you initiate a chargeback or payment dispute in bad faith, we may suspend or terminate your account and revoke access to associated features, credits, or content until the matter is resolved.
- Promotional pricing, introductory offers, and included entitlements may end or change according to the terms shown at the time of offer.
13. Prohibited Conduct
You may not, and may not encourage or assist others to:
- use the Service for unlawful, deceptive, exploitative, or abusive purposes;
- impersonate another person, misrepresent affiliation, or falsely claim authority over an estate, account, or family relationship;
- access or attempt to access accounts, content, tokens, sessions, data, or systems without authorization;
- interfere with the integrity, security, or performance of the Service;
- upload infringing or privacy-violating material;
- use the Service to develop, benchmark, or train competing AI or archival products without our written consent.
14. Moderation, Removal, and Suspension
We may investigate violations, moderate content, remove content, reject uploads, revoke invitations, suspend access, or terminate accounts if we believe, in our sole discretion, that doing so is necessary to protect users, comply with law, enforce these Terms, preserve evidence, reduce legal risk, or protect the Service.
We are not obligated to monitor every account or every item of User Content, and our decision not to act in one instance does not waive any right to act later.
15. Intellectual Property, Feedback, and Third-Party Services
- The Service, including its software, visual design, trademarks, trade dress, text, databases, and non-user content, is owned by HeirStories or its licensors and is protected by law.
- If you provide suggestions, ideas, bug reports, feedback, or feature requests, you grant us a perpetual, irrevocable, royalty-free right to use them without restriction or compensation.
- The Service may integrate with or rely on third-party services, including payment processors, cloud storage, email services, AI providers, and identity providers such as Google. Your use of those third-party services may also be governed by their own terms and privacy policies.
- We are not responsible for third-party products, services, websites, policies, uptime, or acts and omissions.
16. Copyright Complaints
If you believe material available through the Service infringes your copyright, please send a written notice that includes the information required by applicable law, including identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a good-faith statement, and a statement made under penalty of perjury that you are authorized to act. We may remove or disable access to material we reasonably believe may infringe and may terminate repeat infringers where appropriate.
Counter-notices may be submitted where permitted by law. Do not send knowingly false notices or counter-notices.
17. Privacy and Data
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. If there is a conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy controls for the specific data-handling issue.
- You may have access to in-product tools for data access, export, account deletion, or memorial-related controls.
- Deletion requests may not remove data that we must retain for legal, tax, fraud-prevention, dispute-resolution, security, or backup purposes.
- We may preserve logs, transaction records, and evidence relating to abuse, disputes, deceased-account actions, or legal claims.
18. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEIRSTORIES DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF LOSS.
We do not guarantee the long-term availability of any feature, memorial page, domain, file, export format, AI output, or storage configuration. You are responsible for maintaining your own backups of content you care about.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEIRSTORIES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS, EXPECTED SAVINGS, OR CONTENT, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HEIRSTORIES FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
20. Indemnity, Termination, Governing Law, and Changes
- You agree to defend, indemnify, and hold harmless HeirStories and its affiliates, officers, directors, employees, contractors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of another person's rights.
- You may stop using the Service at any time. We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, created risk, failed to pay amounts due, or where required for security or legal reasons.
- Sections that by their nature should survive termination will survive, including sections on licenses granted to us as needed for retained data, billing obligations, disclaimers, limitations of liability, indemnity, governing law, and dispute-related provisions.
- These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Unless applicable law requires otherwise, any dispute arising from or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in California, and each party consents to those courts' personal jurisdiction and venue.
- We may update these Terms from time to time. If we make material changes, we may provide notice by email, through the Service, or by updating the effective date above. Your continued use of the Service after the updated Terms take effect means you accept them.
